Terms of service

Lakolosy is operated by Marindrano, based in Madagascar (“we”, “us”). These terms are an agreement between you and us. If you use Lakolosy for a company, you accept them on its behalf.

Lakolosy lets your apps ring phones with a real incoming call, send push notifications, and hand answered calls to a call provider. It includes the Studio, the REST API, and the @lakolosy/expo and @lakolosy/node packages.

• Give accurate information and keep your password safe.
• You are responsible for everything done with your account and your API keys.
• Keep secret keys on your servers. Never ship them inside an app.
• If you think an account or a key is compromised, rotate the key in the Studio and tell us at tianiazymarindrano@gmail.com.
• You must be at least 16 years old, or the age of digital consent where you live if it is higher.

You decide who your apps ring and notify. You are responsible for:

• having your users' permission to send them rings and notifications;
• following Apple's and Google's rules for push notifications, PushKit, CallKit and full-screen notifications. Apple may reject apps that use CallKit for anything other than calls;
• the APNs keys, Firebase service accounts and Cloudflare RealtimeKit accounts you connect, including anything their providers charge you;
• what your rings and notifications say.

Do not use Lakolosy to:

• ring or notify people who did not agree to it, or send spam;
• harass, threaten or deceive anyone, including with a caller name that impersonates someone else;
• send unlawful content or malware;
• get around rate limits, overload the service, or probe it for weaknesses without our written permission;
• resell Lakolosy as a ringing or push service of your own without our agreement.

Lakolosy is not a telephone service and cannot reach emergency numbers. Do not rely on it for emergencies, safety alerts or anything where a missed ring could cause harm. Whether a phone rings also depends on things we do not control: Apple's and Google's push services, the network, the phone's settings and battery savers, and whether the user force-stopped your app.

Lakolosy is in beta. We work to keep it running, but we do not guarantee any level of availability. We may change, add or remove features. When a change breaks the API or the SDKs, we will try to tell you ahead of time.

Lakolosy is free while it is in beta. Before any paid plan applies to your account, we will tell you the price, and you can choose to stop using the service.

You keep all rights to your content and to your users' data. You allow us to store and process it only to run Lakolosy for you. The privacy policy explains what we collect and how long we keep it.

Lakolosy, the Studio, the API, the SDKs, the name and the logo belong to us or to our licensors. Each SDK comes with the license included in its package. Do not use our branding in a way that suggests your product is ours.

You can stop using Lakolosy at any time, delete your apps in the Studio, and ask us to delete your account at tianiazymarindrano@gmail.com. We may suspend or close an account that breaks these terms or puts the service or other people at risk. When we can, we will warn you first.

Lakolosy is provided as is and as available. To the extent the law allows, we disclaim all warranties, including that the service will be uninterrupted, error free or fit for a particular purpose.

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, or for rings and notifications that were not delivered. Our total liability for any claim is limited to what you paid us in the 12 months before it, or 50 US dollars if that is more.

If someone makes a claim against us because of your apps, your content or your breach of these terms, you agree to cover the reasonable costs of that claim.

We may update these terms. We will change the date at the top and, for important changes, tell you by email or in the Studio. If you keep using Lakolosy after a change, you accept the new terms.

These terms are governed by the laws of Madagascar. Disputes go to the courts of Madagascar, unless the law where you live gives you the right to bring them elsewhere.
